These Terms & Conditions apply to purchases made directly through our website and to your use of the website.
We sell and deliver to customers within the United Kingdom, including Northern Ireland.
Nothing in these Terms & Conditions affects your statutory rights.
2. Products and Product Information
We take reasonable care to ensure that product descriptions, specifications, images and prices displayed on our website are accurate.
Product images are for illustration purposes. Colours and appearance may vary slightly depending on your screen and the manufacturer's production processes.
Please check product descriptions, measurements, sizing information and compatibility requirements before ordering.
Water sports activities can involve risks. Customers should select equipment appropriate to their intended use, experience and conditions, and follow the manufacturer's instructions and relevant safety guidance.
If you need assistance choosing a product, please contact us.
3. Prices and Availability
All prices are displayed in pounds sterling (GBP) and include VAT where applicable.
Delivery charges are calculated and displayed during checkout before you place your order.
Products are subject to availability. Although we make reasonable efforts to keep stock information accurate, occasional stock discrepancies may occur.
If an item is unavailable after you place an order, we will contact you and offer an appropriate alternative, a revised delivery arrangement or a refund.
If we identify an obvious pricing error before accepting your order, we will contact you. You may choose whether to proceed at the correct price or receive a refund of any payment taken.
We will not increase the price of an accepted order without your agreement.
4. Placing an Order
By placing an order, you are offering to purchase the selected goods at the price and on the terms displayed at checkout.
After you submit your order, we will send an order acknowledgement by email.
This acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.
A contract is formed when we confirm that your order has been dispatched, unless we expressly confirm acceptance earlier.
We may decline an order where, for example, goods are unavailable, payment cannot be authorised, an obvious error has occurred or delivery cannot be arranged.
If we cannot accept your order, we will notify you and refund any payment taken for the affected goods.
Please check your order details carefully and contact us promptly if anything is incorrect.
5. Payment
We accept the payment methods displayed during checkout.
Payments are processed securely through the payment services available on our Shopify website and their associated payment providers.
Payment must be authorised before an order can be processed.
Please do not send payment-card details by email or through our AI customer-service assistant.
6. Delivery
We deliver to eligible addresses within the United Kingdom, including Northern Ireland.
Available delivery services, costs and estimated delivery times are displayed during checkout.
For further details, please see our Delivery Information.
We aim to dispatch and deliver orders within the advertised timescales. Delivery estimates are not guaranteed dates unless we expressly agree otherwise.
Unless a different delivery period is agreed, goods will be delivered without undue delay and within 30 days after the contract is formed.
If we are unable to deliver within the agreed or legally required period, you may have the right to cancel and receive a refund in accordance with applicable consumer law.
Delivery problems
Please contact us as soon as reasonably possible if:
- Your parcel has not arrived.
- Your parcel appears damaged.
- Items are missing from your delivery.
- You have received an incorrect product.
Prompt notification helps us investigate with the delivery provider.
However, failure to report a problem within a courier's preferred reporting period does not automatically remove your statutory rights.
Risk and ownership
Goods remain at our risk until they are delivered into your physical possession, or into the possession of a person you have nominated to receive them, except where you independently arrange a carrier that we did not offer.
Ownership of the goods passes to you once payment has been received in full and the goods have been delivered.
7. Your Statutory Right to Cancel
If you are a consumer purchasing goods online, you normally have the legal right to cancel your order without giving a reason.
This right is provided by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Cancellation period
The cancellation period expires 14 days after the day on which you, or a person you nominate other than the carrier, receives the goods.
Where multiple goods are ordered together but delivered separately, the cancellation period normally runs from receipt of the final item.
How to cancel
To exercise your statutory right to cancel, you must clearly communicate your decision to cancel within the 14-day cancellation period.
You do not need to contact us separately or obtain return authorisation before sending goods back.
You may communicate your decision by:
- Including a completed returns form clearly indicating that you wish to cancel or return the goods inside your return parcel.
- Emailing sales@escape-watersports.co.uk.
- Sending a written cancellation notice to our business address.
- Using our optional Model Cancellation Form, available below.
You do not have to use any particular form, provided your decision to cancel is clear.
Where you send your cancellation notice by post, including inside a return parcel, it is sufficient for the notice to be sent before the cancellation deadline, even if we receive it afterwards.
We recommend keeping proof of posting.
Simply returning goods without any clear statement of your decision to cancel does not, by itself, exercise the statutory cancellation right.
Returning goods after cancellation
You must send the goods back without undue delay and no later than 14 days after communicating your decision to cancel.
Unless we have agreed otherwise or the law requires us to cover the cost, you are responsible for the direct cost of returning unwanted goods.
You may use our optional £3 Royal Mail returns-label service where the parcel is eligible.
Inspecting goods
You may handle and inspect goods to establish their nature, characteristics and functioning, as you would reasonably be able to do in a shop.
You may be responsible for any reduction in value caused by handling beyond what is necessary for that purpose.
Where permitted by law, we may make an appropriate deduction from your refund to reflect that reduction in value.
Removing packaging or trying on an item does not automatically remove your statutory cancellation right.
Refunds following statutory cancellation
Where you cancel your entire order under your statutory cancellation right, we will refund:
- The price paid for the cancelled goods.
- The cost of the least expensive standard delivery service offered for that order.
If you selected a more expensive delivery option, we are not required to refund the additional cost.
Where only part of an order is cancelled, the amount of any delivery refund will depend on the circumstances and applicable law.
We will issue the refund without undue delay and no later than 14 days after receiving the returned goods or receiving evidence that you have sent them back, whichever is earlier.
We may withhold the refund until we receive the goods or evidence of their return.
Refunds will normally be made using the original payment method unless you expressly agree otherwise. We will not charge a refund fee.
Exceptions to cancellation rights
Certain goods may be exempt from the statutory cancellation right where the relevant legal conditions apply.
Examples include:
- Goods made to your specifications or clearly personalised.
- Sealed goods that are unsuitable for return for health protection or hygiene reasons, once unsealed after delivery.
Any applicable restriction will be identified before purchase where required.
These exceptions do not remove your statutory rights concerning faulty or misdescribed goods.
8. Our Additional 30-Day Returns Policy
In addition to your statutory cancellation rights, Escape Watersports offers a voluntary 30-day returns policy for unwanted or unsuitable goods purchased directly from our website.
To qualify under this additional policy:
- Goods must be returned within 30 days of receipt.
- Goods must be unused and undamaged.
- Original labels, tags and packaging must be included.
- You are responsible for return postage unless we agree otherwise.
- Any product-specific restrictions disclosed before purchase must be observed, subject to your statutory rights.
How to return an item
You do not need to contact us or obtain return authorisation before sending back an unwanted item under this policy.
Simply complete the returns form supplied with your order and include it inside your parcel.
Please package goods securely to prevent damage in transit.
Return postage
You may arrange your own suitable return delivery service.
Alternatively, we offer an optional Royal Mail returns label costing £3, where the parcel is eligible.
If you use this service, the £3 charge will be deducted from your refund.
Some items may be unsuitable for Royal Mail returns because of their size, weight or contents.
Refunds under our voluntary policy
Where goods meet the conditions of our additional 30-day returns policy, we will refund the amount paid for the returned goods.
Original delivery charges are not normally refunded under this voluntary policy, except where required by law or expressly agreed.
This does not affect any entitlement to a delivery refund under your statutory cancellation rights.
Exchanges
We do not offer direct exchanges.
If you require a different size, colour or product, please return the original item in accordance with the applicable returns terms and place a new order.
Important distinction
Our voluntary 30-day returns policy is an additional benefit.
It does not replace, restrict or reduce your statutory 14-day cancellation rights or your rights concerning faulty, damaged or misdescribed goods.
For full instructions, please see our Returns Policy.
9. Faulty, Damaged or Incorrect Goods
Under the Consumer Rights Act 2015, goods must be:
- Of satisfactory quality.
- Fit for their intended purpose, where applicable.
- As described.
If goods do not meet these requirements, you may be entitled to a refund, repair, replacement or price reduction, depending on the circumstances.
Consumers generally have a short-term right to reject faulty goods within 30 days, subject to the applicable legal rules.
Other remedies may remain available after that period.
Reporting a fault
If you experience a problem with a product, please contact us or complete the warranty form available through our website.
We may ask for photographs, a description of the issue, proof of purchase or an opportunity to inspect the product.
In some circumstances, an item may need to be returned to us or inspected by the manufacturer to establish the appropriate remedy.
Any inspection or manufacturer's involvement will not remove our responsibilities to you as the retailer.
Where goods do not conform to the contract, we will meet our legal obligations concerning return costs and remedies.
Manufacturer warranties
Some products include a manufacturer's warranty.
Manufacturer warranties are provided in addition to your statutory rights and do not replace them.
Your legal rights against Escape Watersports remain unaffected by the terms or duration of any manufacturer's warranty.
10. Returns Involving Restricted or Hazardous Goods
Certain water sports products, including items containing CO₂ cylinders or other restricted components, may be subject to postal and courier restrictions.
Please contact us before returning such products if you are unsure which delivery service can safely and lawfully carry them.
Our optional Royal Mail returns service may not be suitable for these items.
Products should be returned clean and packaged safely, where reasonably practicable.
These requirements do not remove your statutory rights. Where we are legally responsible for arranging or paying for the return of faulty goods, we will make appropriate arrangements.
11. Discount Codes and Promotions
Discount codes and promotional offers are subject to any conditions displayed when the offer is made.
Unless stated otherwise:
- Discount codes must be entered before checkout is completed.
- Discount codes cannot be applied retrospectively.
- Codes cannot be exchanged for cash.
- Only one discount code may be used per order.
- Certain products may be excluded.
- Promotions may be subject to expiry dates, stock availability or other clearly stated conditions.
- Discount codes are valid for online purchases only.
We may amend or withdraw promotional offers for future orders.
Changes will not affect orders already accepted or rights acquired under a validly redeemed promotion.
12. Gift Vouchers
Escape Watersports gift vouchers are valid for 12 months from the date of purchase, unless a different period is expressly stated when purchased.
Gift vouchers can be redeemed against eligible purchases made through our website.
Using gift vouchers
- Each voucher has a unique redemption code.
- If the order value exceeds the voucher balance, the difference must be paid using another accepted payment method.
- If the full voucher balance is not used, the remaining balance may be used for another purchase before the original expiry date.
- Gift vouchers cannot be applied retrospectively to orders already placed.
- Gift vouchers cannot ordinarily be exchanged for cash, except where required by law.
Refunds for orders paid using gift vouchers
Where an order was paid for using a gift voucher, refunds will ordinarily be credited back to the gift voucher for the amount originally paid using it.
Where a combination of voucher balance and another payment method was used, refunds will be allocated appropriately between those methods.
Any refunded voucher balance will normally retain its original expiry date, subject to your statutory rights and any applicable legal requirements.
Nothing in these terms restricts any statutory cancellation or refund rights that apply to gift vouchers or purchases made using them.
13. Price Match
If you find an identical product advertised for less by another eligible UK online retailer, we may be able to match the price.
To request a price match, please contact us before purchasing and provide:
- The competitor's name.
- A link to the product.
- The advertised price, including VAT.
- Any applicable delivery charges.
Price-match conditions
- The product must be new and identical in brand, model, specification, size and colour.
- It must be in stock and available for immediate purchase from the competitor.
- The competitor must be a UK VAT-registered retailer operating a UK website.
- We compare the total purchase price, including relevant delivery charges.
- Auction listings and private sales are excluded.
- Competitor discount codes and promotional offers may be excluded.
- Price-match requests must be made before purchase.
- We do not offer retrospective price-match refunds.
Price matching is discretionary and subject to confirmation by Escape Watersports.
We may amend or withdraw the scheme for future requests.
14. Customer Accounts and Website Use
You are responsible for providing accurate information when placing orders and for keeping your account login details secure.
Please notify us promptly if you believe your account has been accessed without authorisation.
You must not misuse our website, attempt to interfere with its operation or use it for unlawful purposes.
We may restrict access where reasonably necessary to protect the website, customers or our business, without unfairly affecting your statutory rights.
15. AI Customer-Service Assistant
Our website uses an AI-powered customer-service assistant provided by Aspect, Inc., trading as Anagram.
The assistant may help answer product questions, provide general information and assist with customer-service enquiries.
By using the assistant, you acknowledge that you are interacting with an automated system.
Although we aim to provide useful and accurate information, AI-generated responses may occasionally be incomplete, outdated or incorrect.
For important matters such as equipment safety, compatibility, technical specifications, prices, delivery arrangements or legal rights, please check the relevant website information or contact our team directly.
Information provided by the assistant does not override your statutory rights or an accepted order contract.
Please do not enter payment-card details, passwords or unnecessary sensitive personal information into the chat.
Information submitted through the assistant may be processed by our AI service provider as described in our Privacy Policy.
Nothing in this section excludes or restricts liability that cannot lawfully be excluded.

You must not reproduce substantial parts of our content for commercial use without permission, except where permitted by law.
Our website may include links to independent third-party websites. Those websites operate under their own terms and policies.
17. Our Responsibility to You
We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms & Conditions or our failure to use reasonable care and skill.
Nothing in these terms excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Breach of statutory consumer rights.
- Any other liability that cannot legally be excluded or limited.
We are not responsible for losses that are not a foreseeable consequence of our breach or that are caused solely by circumstances for which we are not legally responsible.
If you purchase goods as a consumer, we supply them for personal and private use.
Nothing in this section removes any legal remedy available to you.
18. Events Outside Our Reasonable Control
We are not responsible for delays caused by events outside our reasonable control where the law permits this.
If such an event affects your order, we will take reasonable steps to minimise disruption and keep you informed.
Your statutory rights relating to delayed or failed delivery remain unaffected.
19. Privacy and Personal Information
We process personal information in accordance with our Privacy Policy.
Our Privacy Policy explains how we collect, use and protect personal information, including information processed through our ecommerce platform, marketing services, analytics tools and AI customer-service assistant.
20. Changes to These Terms
We may update these Terms & Conditions from time to time.
The terms applying to an order will normally be those in effect when the order was placed, unless a change is required by law or expressly agreed with you.
The latest version will be available on our website.
21. Governing Law and Disputes
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer living in Scotland or Northern Ireland, you retain the benefit of any mandatory consumer protections applicable to you.
You may bring legal proceedings in the courts available to you under applicable law.
If you have a complaint, please contact us first so that we can try to resolve the matter promptly.
Nothing in this section prevents you from exercising your legal rights.
